There is allegation against the petitioners. On 28.08.2015 all the FIR named accused persons were assaulted her daughter in law namely Maharami Khatoon, who was pregnant on the point of quarreling of the children with fists and slaps as a result she sustained internal injury. The informant further alleged that in the night of 21-22.09.2015 her daughter in law gave birth a dead child at Govt. Hospital, Bhutha. Further she raised suspicion due to alleged assault her daughter in law gave birth a dead child.

It has been submitted by learned counsel for the

Patna High Court CR. MISC. No.35986 of 2019(2) dt.10-06-2019 2/2 petitioners that date of occurrence is on 28.08.2015 but FIR was lodged on 22.09.2015 and there is delay of more than 15 days. Let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending in connection with Sikty P.S. Case No. 99 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
