The petitioner is accused in connection with Muffasil P. S. Case No. 92 of 2016 registered under Sections 47 (a) of the Bihar Excise (Amendment) Act, 2016.
Accusation is of recovery of 48 cartoons each containing 48 bottles of 180 ml. Indian made foreign liquor from the house of the petitioner.
Learned counsel appearing on behalf of the petitioner submits that the petitioner used to reside at Faridabad and he was not at his house at the time of the occurrence when the petitioner came to his village in the month of January, 2017 he was
Patna High Court Cr.Misc. No.11228 of 2017 (2) dt.16-03-2017 2/2 apprehended by the police on 03.01.2017 and since then he is in custody.
Having regard to the facts and the circumstances of the case, the petitioner, namely Nawal Mandal, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Munger, in connection with Mufassil P.
