JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 02-02-2021 Heard learned counsel for the petitioner and learned counsel appearing on behalf of opposite party. The petitioner is in custody in connection with Ghorasahan P.S. Case No. 233 of 2020 for the offences under Sections 399, 402, 414 of the Indian Penal Code and Sections 25(1-B) a, 26, 35 of the Arms Act. The prosecution case as per F.I.R is that on secret information that criminals have gathered in the house of one Madhusudan Kushwaha to commit dacoity, raid was laid and eleven accused persons including the petitioner were arrested. From the possession of the
Patna High Court CR. MISC. No.37198 of 2020(2) dt.02-02-2021 2/2 petitioner, a knife from the left pocket of the pant of the petitioner was recovered.
Learned counsel appearing on behalf of the petitioner would submits that petitioner has no criminal antecedent and he is in custody since 20.06.2020. Considering the fact that petitioner is not having any criminal antecedent and the period of custody, this Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 50,000/- (Rupees fifty thousands) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sikarahna at Dhaka, East Champaran in connection with Ghorasahan P.S.
