JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 27-01-2021 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Ballia P.S. Case No. 350 of 2014 for the offence under Sections 395 and 109 of the Indian Penal Code.

Learned counsel for the petitioner submits that name of the petitioner was not named in the first information report and his name surfaced on the basis of confessional statement of co-accused Irshadujama @ Anna. Learned counsel submits that no incriminating article was seized from possession of the petitioner. As the petitioner is in custody since 16.01.2020, he has not yet been put on test identification parade. Considering the aforesaid, the Court is inclined to
