JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 02-07-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State.

The petitioner seeks anticipatory bail in a case registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code.

The petitioner is daughter of the sister of the husband of the deceased who was married to Santosh Sharma in the year 2003 and is said to have died on 18.09.2014. Allegedly, demands for dowry were made.

Learned senior counsel appearing on behalf of the petitioner submits that no case under Section 302 is made on the basis of the contents of the First Information Report so far as this petitioner is concerned. I find substance in the

Patna High Court Cr.Misc. No.19290 of 2015 (3) dt.02-07-2015 application, the application is allowed.

In view of the submission as above, let above named petitioner in the event of his arrest/surrender within four weeks from today in the court below, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Chhapra, in connection with Manjhi P.S. Case No. 161 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Chakradhari Sharan Singh, J) P.K./- U T
