JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-04-2021 Mr. Anil Kumar, learned counsel for the petitioners seeks permission to withdraw this petition with respect to petitioner no. 1 as he has been arrested. The application with respect to petitioner no. 1 is dismissed as withdrawn.

The petitioner no. 2 seeks bail in anticipation of his arrest in connection with Hajipur Sadar P. S. Case No. 173 of 2020, dated 07.03.2020, instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Patna High Court CR. MISC. No.36005 of 2020(2) dt.05-04-2021 2/3 It has been submitted on behalf of the petitioner no. 2 that he has been named by some of the persons as having fled away from the place where raid was conducted and there was recovery of about 90 litres of liquor.

The petitioner does not have criminal antecedents.

Regard being had to the nature of accusation against the petitioner no. 2, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned learned 2nd Additional Sessions Judge cum Special Judge, Excise Court, Vaishali at Hajipur, in connection with Hajipur Sadar P. S. Case No. 173 of 2020, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
