1. Heard learned counsel for the parties.

2. The petitioners have renewed their prayer for grant of regular bail in connection with Sessions Trial no.53 of 2024, arising out of Chausa (Fulaut O.P.) P.S. Case no. 81 of 2023 registered under sections 307 and 34 of the Indian Penal Code and section 27 of the Arms Act.

3. As per the prosecution case, as a result of firing resorted to by the two petitioners herein, the informant sustained gunshot injuries.

4. It transpires from the contents of the petition that the earlier prayer for bail of the petitioners was rejected vide order dated 17.2.2024 (Annexure-1) passed in Cr. Misc. no.

Patna High Court CR. MISC. No.45108 of 2024(2) dt.16-07-2024 2/2 6716 of 2024, giving liberty to the petitioners to renew their prayer for bail after framing of charge. From perusal of the order dated 9.4.2024 contained in Annexure-4, it transpires that charge has been framed against the petitioners. The petitioners are in custody since 1.11.2023.

5. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioners, liberty granted to the petitioners by the aforesaid order of rejection dated 17.2.2024, charge having been framed in the case together with the petitioners having remained in custody since 1.11.2023, both the petitioners are directed to be enlarged on bail in connection with Sessions Trial no.53 of 2024 [arising out of Chausa (Fulaut O.P.) P.S. Case no. 81 of 2023] on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-III, Madhepura.
