The petitioner has filed the instant application for grant of regular bail in connection with Ahiyapur P.S. Case No. 559 of 2019 registered under section 394 of the Indian Penal Code.

As per allegation in the FIR, the accused persons are stated to have looted the informant on the point of pistol. It is submitted by learned counsel for the petitioner that the name of the petitioner transpired in the confessional statement of co-accused made before the police. Neither any incriminating article has been recovered from the house or possession of the petitioner nor has the petitioner been put on T.I. Parade. The investigation of the case has been concluded

Patna High Court CR. MISC. No.35682 of 2020(3) dt.18-01-2021 2/2 with submission of the charge-sheet. The petitioner is in custody since 20.5.2020.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the fact that charge-sheet has been submitted in the case without putting the petitioner on T.I. parade, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Ahiyapur P.S. Case No. 559 of 2019 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur.
