The petitioner seeks bail in Rohtas P.S. Case No. 204 of 2016, registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.

The widow of the deceased alleged that Santosh Singh, the petitioner took her husband on a motorcycle on 08.11.2016 but her husband did not return. On 11.11.2016, the villagers informed that the dead body of her husband was lying by the side of a river. Learned counsel for the petitioner submits that there is no eye witness of the occurrence. The deceased used to go along with the petitioner but the deceased used to return after completion of the work. On 08.11.2016, the deceased left the company of the petitioner for going to his house but he did not return. The

Patna High Court Cr.Misc. No.11613 of 2017 (3) dt.07-04-2017 2/2 petitioner had no knowledge about his missing. The petitioner has got no enmity with the deceased.

Considering the facts aforesaid and the fact that save and except suspicion there appears no tangible material against the petitioner, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Dehari, Rohtas at Sasaram in Rohtas P.S. Case No. 204 of 2016.
