2. The petitioners have prayed for bail in connection with Sessions Trial No. 1474 of 2025 arising out of Mahuawa P.S. Case No.123 of 2025 registered for the offence punishable under Section 310(2) of the BNS.
3. The case of the prosecution, in short, is that unknown miscreants have entered in the house of the informant and on gun point committed dacoity.
4. Learned counsel appearing on behalf of the petitioners has submitted that the FIR was lodged against unknown miscreants. During course of investigation the petitioners were apprehended and they have given their
Patna High Court CR. MISC. No.37928 of 2026(2) dt.17-06-2026 2/2 confessional statement before police. It has further been submitted that save and except confessional statement of the petitioners there is nothing against them. No recovery has been made from the possession of the petitioners. It has further been submitted that the petitioner no.1 is having two criminal antecedents and petitioner no.2 is having three criminal antecedents. It has lastly been submitted that the petitioners are in judicial custody since 19.02.2026.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the court of learned S.D.J.M., Raxaul at Motihari, East Champaran in connection with Mahuawa P.S.
