The petitioner has preferred this application for grant of regular bail in a case registered under section 498A of the Indian Penal Code and sections 3 and 4 of the Dowry Prohibition Act. As per the prosecution case, the informant was married to the petitioner herein on 6.2.2019. It is stated that soon after the marriage, the petitioner along with other accused persons started to physically and mentally torture the informant for non fulfillment of the demand of dowry to the tune of Rs. 5 lacs and a car. Ultimately she was forcibly taken on a Bolero vehicle and left at the chowk near her parents place.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case only for the reason of his being the husband of the informant. Referring to the materials on record, it is submitted that it was the father of the

No.49238 of 2021(3) dt.23-03-2022 2/2 informant who under threat made a demand of heavy amount from the petitioner and his father where on the father of the petitioner transferred a sum of Rs. 1 lac in the account of father of the informant. The allegations are general and omnibus in nature. The petitioner is in custody since 13.7.2021 and the earlier case referred to in paragraph no. 3 of the petition has also been filed by the father of the informant against this petitioner.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the submissions made on behalf of the petitioner, the petitioner having remained in custody for more than 8 months and chargesheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Dighwara P.S. Case no. 153 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate IX, Chapra, District Saran.
