1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 457, 380 and 411 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent. It is further submitted that similarly situated co-accused, namely, Guddu Kumar @ Guddu Halwai @ Shankar has been granted the privilege of anticipatory bail by a learned Coordinate Bench of this Court vide order dated 25.08.2023 passed in Cr. Misc. No. 48438 of 2023. It is next submitted that case of the petitioner is on similar footing.
4. Learned counsel for the petitioner submits that in sum and substance, the allegation in the FIR is that on 14.09.2022, at about 01:00 a.m., when the informant was sleeping she heard

No.37894 of 2025(2) dt.25-06-2025 2/2 some sound and found that 4-5 persons had entered her house to commit theft on which she raised alarm when the miscreants succeeded in fleeing away except one who was apprehended and disclosed his name as Ravi Bhushan @ Niraj Sharma. Further, the accused persons committed theft of gold chain, silver bowl and other precious articles of the informant. It is further submitted that name of Guddu Kumar and the petitioner was disclosed by Ravi Bhushan.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner, let the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Paliganj P.S. Case No. 406 of 2022, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
