The petitioner seeks bail in Kishanganj P.S. Case No. 565/2016, registered for the offences punishable under Sections 370, 372, 373, 120B of the Indian Penal Code and sections 3, 4 and 5 of Immoral Traffic Prevention Act and sections 4 and 6 of the P.O.C.S.O Act.

The police raided the house of Tunni and one person was arrested while fleeing away from the house. One girl with a boy was found in objectionable condition. Moni Khatun recovered girl aged about 23 years disclosed that Tunni brought her one month prior for prostitution. Other girls and boys were apprehended.

Learned counsel for the petitioner submits that petitioner

Patna High Court Cr.Misc. No.10004 of 2017 (3) dt.27-03-2017 is brother of Tunni and allegation of immoral traffic is not made against the petitioner. The petitioner came there for repairing of tube well. The petitioner is in jail since 15.12.2016. Considering the facts aforesaid and nature of allegation made against the petitioner, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge Ist - cum-Special Judge (S.C./S.T.), P.O.C.S.O N.D.P.S. Act, Kishanganj in connection with Kishanganj P.S. Case No. 565/2016. (Prabhat Kumar Jha, J.) Vinita/- U T
