1. Heard the parties.

2. The petitioner apprehends his arrest in connection with Special Excise case No. 102 of 2025 arising out of Bikram P.S. Case No. 102 of 2025 dated 10.03.2025 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per the first information report on 09.03.2025 police intercepted an Alto Car which was parked near the road side in which two persons were sitting one was on the driving seat and another was on the back seat. Upon seeing the police party they started fleeing away however Police arrested one person, who was sitting on the back seat namely Badal Kumar. Upon search, 09 liters of foreign liquor was recovered from the Alto car. The arrested person Badal Kumar disclosed the name of the petitioner, who was driving the said car.

4. Learned counsel for the petitioner submits that petitioner

Patna High Court CR. MISC. No.37005 of 2025(2) dt.25-06-2025 2/2 has no criminal antecedent and he has been implicated in this case on the basis of disclosure of his name by the arrested co-accused Badal Kumar.

Regard being had to the submission made by the parties, taking into consideration the fact that petitioner is not the owner of vehicle and illicit liquor has not been recovered from the conscious possession and / or vehicle belonging to the petitioner, as such, I am inclined to grant anticipatory bail to the petitioner.

6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Danapur in connection with Special Excise Case No. 102 of 2025 arising out of Bikram P.S. Case No. 102 / 2025 subject to the condition as laid down under Section 482 (2) of the B.N.S.S. 2023.
