The petitioner seeks bail in Khodabandpur P.S. Case No. 62 of 2011 registered under Sections 302, 201 and 34 of the Indian Penal Code.
The informant alleged that his son Arjun Kumar went outside his house but he did not return. During the course of search, Ram Udgar Mahto and two-three persons disclosed that a dead body is lying in the orchard of Basudeo Mahto. The informant identified the dead body of his son and alleged that it appears that some unknown persons assaulted his son and killed him.
Leanred counsel for the petitioner submits that the petitioner is not named in the F.I.R. The petitioner happens to be
Patna High Court Cr.Misc. No.19196 of 2017 (2) dt.01-05-2017 2/2 the grand son of Bhola Chaudhary. It is also alleged that the deceased was in illicit relationship with the daughter of one Chandra Shekhar Mahto. On mere suspicion, the name of the petitioner also figured in the case. Sunil Kumar, Bhola Chaudhary and Chandra Shekhar Mahto have already been enlarged on regular bail. The case of the petitioner stands on better footing. Except suspicion, there is no material against the petitioner.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Manjhaul, Begusarai in connection with Khodabandpur P.S. Case No. 62 of 2011.
