Pandit (App) ====================================================== CORAM: HON'BLE MR JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 10-06-2015 Learned counsel states that petitioner No 3 Hridya Devi has died during pendency of this application and application on her behalf abates. This application is, accordingly, dismissed in so far as petitioner No 3 Hridya Devi is concerned. Petitioners No 1 and 2 are husband and wife and apprehend arrest in relation to Aurangabad Town Police Station (PS) Case No 29 of 2015 instituted under Sections 420, 467, 468, 471, 472 of Indian Penal Code.
It is alleged that Hridya Devi was the mother of petitioner No 2. She had sold certain lands but the allegation of the complainant/informant is that the land has already been gifted
Patna High Court Cr.Misc. No.17943 of 2015 (2) dt.10-06-2015 to the complainant and, as such, the sale was legally incorrect. Learned counsel submits that prima facie the allegation shows that this is a civil dispute which has been maliciously made as land dispute.
Be that as it may, in the event of their arrest or surrender within four weeks from today, the petitioners abovenamed shall be released on bail on each of them furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in Aurangabad Town PS Case No 29 of 2015 subject to all conditions as laid down in Section 438 (2) of Criminal Procedure Code.
