Petitioners apprehend their arrest in connection with Dandari P.S. Case No. 57 of 2013 registered for the offences punishable under Sections 302, 120b/34 of the Indian Penal Code. Allegedly, the dead body of the informant's son was recovered from the house of Siya Ram Yadav. It is alleged that the petitioners and others after making criminal conspiracy have killed informant's son as his son was having love affairs with Rukhminia Kumari.
Submission is of false implication and that earlier U.D. case was registered wherein no suspicion has been raised against anyone and later on the FIR has been lodged wherein all the family members have been implicated. One of the co-accused
Patna High Court Cr.Misc. No.42234 of 2014 (2) dt.04-03-2015 Shankar Yadav has been allowed bail by another Bench of this Court vide order dated 225.2014 passed in Cr. Misc. No. 15267 of 2014 and the petitioners being ladies deserve sympathetic consideration to which the learned APP opposes. In the facts and circumstances stated above, considering the gender of the petitioners and further as earlier U.D. case was registered wherein no suspicion has been raised against any one, the petitioners above named, in case of their surrender or arrest within two months from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Dandari P.S. Case No. 57 of 2013, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
