2. Petitioner seeks regular bail in connection with Janta Bazar P. S. Case No. 283 of 2024 in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.

3. As per the prosecution case, 43.2 liters of illicit liquor were recovered from the motorcycle of the petitioner.

4. Learned counsel for the petitioner submits that he is innocent and has committed no offence. He has been falsely implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery. It has been submitted that the petitioner has given his motorcycle to his

Patna High Court CR. MISC. No.39509 of 2025(2) dt.08-08-2025 2/2 friend Nikesh Kumar Sah for some personal work and he has no knowledge that the same has been used in transporting illicit liquor. Petitioner is in custody since 06.05.2025. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State vehemently opposes the bail application.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No.-3, Saran (Chapra) in connection with Janta Bazar P. S. Case No. 283 of 2024.
