JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 04-03-2015 Heard learned counsel for the petitioners and learned counsel representing the State.
Petitioners apprehend their arrest in connection with Sanjhauli P.S. Case No. 30 of 2014 registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code.
Allegedly, due to non-fulfillment of demand of dowry by way of motorcycle, the daughter of the informant who was married with son of the petitioners was burnt to death and her dead body was also cremated.
Submission is of false implication and that there is no specific allegation against the petitioners. The petitioners have
Patna High Court Cr.Misc. No.42241 of 2014 (2) dt.04-03-2015 got no concern with the family affairs of the informant's daughter and her husband. The husband of the deceased has already surrendered and he is in custody, and as such, the petitioners deserve sympathetic consideration to which the learned APP dully assisted by the learned counsel for the petitioner opposes the prayer of pre-arrest bail.
Considering that there is no specific allegation against the petitioners and the husband of the deceased is in custody, the petitioners above named, in case of their surrender or arrest within two months from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Bikramganj, Rohtas in connection with Sanjhauli P.S. Case No. 30 of 2014, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
