JUSTICE SANJAY PRIYA ORAL ORDER 4/ 25-05-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The Petitioner seeks bail in Barahiya P.S. Case No.194 of 2016 instituted for the offence under Section(s) 25(1-b) A, 26 of the Arms Act.

There is allegation against the petitioner that two loaded country made pistol were recovered from his possession. It has been submitted by the learned APP that he is accused in five other cases.

Counsel for the petitioner has submitted that he has been granted bail in all the five cases. The petitioner is in custody since 22.10.2016.

Keeping in view the period of custody, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above

Patna High Court Cr.Misc. No.19524 of 2017 (4) dt.25-05-2017 2/2 named, be released on bail on furnishing bail bond of `10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Lakhisarai, in connection with Barahiya P.S. Case No.194 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.

The petitioner will remain present on each and every date of trial and will not intimidate or harass the witnesses. Bail bond of the petitioner will be liable to be cancelled on account of his absence on two consecutive dates.
