====================================================== CORAM: HONOURABLE MR. JUSTICE RAJESH KUMAR VERMA ORAL ORDER 25-10-2021 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

Let the defects, as pointed out by the office, be removed within four weeks of start of normal functioning of the physical court.

Petitioners apprehend their arrest in connection with Chautham P.S. Case No. 137 of 2020 registered for the offence punishable under Section 304(B) of the I.P.C. According to prosecution case, petitioners along with the other family members killed the informant's daughter by strangulating her due to non-fulfillment of dowry demand. Learned counsel for the petitioners submits that

Patna High Court CR. MISC. No.36374 of 2020(5) dt.25-10-2021 2/2 petitioners are Bhaisur and Gotini of the deceased Sanju Devi. He further submits that petitioners used to reside separately from Kapildeo Yadav @ Poplesh Yadav.

The learned Additional Public Prosecutor, however, opposed the prayer of bail.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within a period of six weeks from today, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Khagaria/concerned court in Chautham P.S. Case No. 137 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
