JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 10-06-2015 The petitioner, who is the husband, apprehends his arrest in relation to Complaint Case No.3320(C) of 2011 instituted by his estranged wife under Section-498 A of the Indian Penal Code and Section-3⁄4 of the Dowry Prohibition Act.
Learned counsel for the petitioner states that the marriage has taken place about seven years back. He has also drawn attention of the Court to the fact that a petition for restitution of conjugal right at the instance of the petitioner has already been filed and is pending.
Be that as it may, not granting bail to the petitioner would not be conducive to restoration of matrimonial relationship. In the facts and circumstances aforesaid, in the event of arrest or surrender within four weeks from today, the petitioner,
Patna High Court Cr.Misc. No.17959 of 2015 (02) dt.10-06-2015 2/2 namely, Sales Yadav alias Shailesh Yadav alias Sailesh Yadav, shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of S.D.J.M., Patna in connection with Complaint Case No.3320(C) of 2011, subject to all conditions as laid down in Section-438(2) of the Criminal Procedure Code.
