The petitioner seeks bail in Nayagaon P.S. Case No. 26/2019, instituted for offence under Section(s) 414 of the Indian Penal Code read with Section 25(1-b)a and 26 of Arms Act as well as Section 37(c) of the Bihar Prohibition and Excise Act.
It is alleged in the written report that during patrolling duty police apprehended two persons on motorcycle, who disclosed their name as Manohar Rai and petitioner. The police recovered one Desi Katta and two live cartridges from their possession. The accused persons were found in drunken condition.
Learned counsel for petitioner has submitted that
Patna High Court CR. MISC. No.39039 of 2019(3) dt.20-08-2019 2/2 there is no specific allegation against this petitioner in the written report of recovery of firearm from his possession. Petitioner is in custody since 28.02.2019.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra, in connection with Nayagaon P.S. Case No. 26/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
