1. Heard Mr. Subesh Sharma, learned counsel for the petitioners and Mr. Anil Prasad Singh, learned APP for the State.

2. The petitioners apprehend their arrest in connection with Simri Bakhtiyarpur (Kanariya O.P.) P. S. Case No. 111 of 2021 dated 01.04.2021 registered for the offence(s) punishable under Section(s) 447, 341, 323, 324, 307, 379, 427, 504, 506/34 of the Indian Penal Code.

3. The main submissions advanced by the petitioners' counsel are that the investigation has been completed against

No.39526 of 2025(2) dt.27-06-2025 2/3 the petitioners and they have fair and clean antecedent and the investigating officer has given the benefit of Section 41(1) of Cr.P.C. to the petitioners but the trial court has issued summons against them for their appearance due to which they have apprehension of their arrest and so far as the nature of allegation is concerned the main allegation is against the co-accused Sundrwan Singh and in this matter, there is only one injured person whose injury has been opined to be simple in nature.

4. Learned APP appearing for the State has opposed the bail prayer of the petitioners.

Considering the aforesaid submissions advanced by petitioners' counsel and mainly taking into account the petitioners' fair and clean antecedent and completion of investigation against them and also the nature of allegation appearing against them, this court is inclined to grant the relief of anticipatory bail to the petitioners. Accordingly, let the petitioners named-above, in the event of their arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail in connection with Simri Bakhtiyarpur (Kanariya O.P.) P. S. Case No. 111 of 2021 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the
