Petitioner apprehends his arrest in Complaint Case No.60C2 of 2019, registered under Sections 30(a) and 37(b) of the Bihar Prohibition and Excise Act.

According to the prosecution report, Puneet Mahto was apprehended and alcoholic smell was coming from his mouth. Puneet Mahto is said to have disclosed that the petitioner made available the liquor to him.

It is submitted that nine litres of country made liquor was recovered from a bamboo bush situated near the house of the petitioner and for that the petitioner has also been made accused in the case.

It appears that nothing has been recovered from the

Patna High Court CR. MISC. No.37977 of 2019(2) dt.21-06-2019 2/2 house of the petitioner. Recovery was made from bamboo bush and petitioner has got no criminal antecedent. Considering the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Excise Act, Begusarai in connection with Complaint Case No.60C2 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
