The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 504 and 379/34 of the Indian Penal Code.
It is specifically alleged that petitioner no. 1 Kishan Sahni assaulted Prem Shankar Sahni with knife on his neck and left shoulder and co-accused Madan Sahni (nonpetitioner) assaulted the informant with axe on his head. There is omnibus and general accusation of assault to the informant and
Patna High Court Cr.Misc. No.20730 of 2015 (02) dt.05-05-2015 2/2 Prem Shankar Sahni is against all the accused persons. Considering the specific accusation of assault against petitioner no. 1, let the learned court below consider the prayer for regular bail of petitioner no. 1, if he surrenders within a period of six weeks from today. So far as petitioner nos. 2 and 3 are concerned, since there is omnibus and general accusation of assault and a statement has been made in para 3 of the petition that the petitioners have no criminal antecedent, let the above named petitioner nos. 2 and 3 be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheohar in connection with Tariyani P.S. Case No. 87 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
