1. Heard the parties.

2. The petitioner apprehends his arrest in connection with Katihar Town P.S. Case No.1000 of 2024 dated 28.12.2024 registered under Section 30(a), 41, 44 (1), 47 of the Bihar Prohibition and Excise Act.

3. As per the prosecution case a total quantity of 60 liters of illicit country made liquor has been recovered from a Scooty bearing Registration No. BR39Y-3933 and the Police arrested one co-accused Kishan Kumar.

4. Learned counsel for the petitioner submits that petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case. From perusal of the F.I.R. it is evident that illicit country made wine has been recovered from the arrested co-accused Kishan Kumar who in his confessional statement disclosed the name of the petitioner and

Patna High Court CR. MISC. No.37003 of 2025(2) dt.25-06-2025 2/2 one Kanhaiya Paswan. Illicit country made liquor has not been recovered from the conscious possession and / or vehicle belonging to the petitioner. The Scooty in question does not belong to the petitioner.

Regard being had to the submission made by the parties, taking into consideration the fact that petitioner is not the owner of the Scooty in question and no illicit liquor has been recovered from the conscious possession and / or vehicle belonging to the petitioner, accordingly, I am inclined to grant anticipatory bail to the petitioner.

6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court -II, Katihar in connection with Katihar Town P.S. Case No. 1000 of 2024 subject to the condition as laid down under Section 482 (2) of the B.N.S.S. 2023. praful/- (Anil Kumar Sinha, J) U T
