The petitioner seeks bail in Mojahidpur (Babarganj) P. S. Case No. 79 of 2018 instituted for the offence under Section(s) 341, 323, 307, 337,504 and 506/34 of the Indian Penal Code and Section 3, 4 and 5 of the Explosive Substance Act, 1908.

Learned counsel for petitioner submits that there is general and omnibus allegation against this petitioner in the written report. The petitioner was assaulted by the person of the informant's side for which petitioner was medically examined and in the C.T. scan, it was found depressed fracture left parietal bone with epidural hematoma. The father of petitioner, namely, Dasarath Paswan lodged an FIR being Mojahidpur

Patna High Court CR. MISC. No.37367 of 2019(2) dt.20-06-2019 2/2 ( Babarganj) P.S. case no. 200of 2016 against the relative of the informant and others. The instant case has been filed only to put pressure on the petitioner to compromise the matter. Petitioner is in custody since 31.10.2018.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the CJM, Bhagalpur, in connection with Mojahidpur (Babarganj) P. S. Case No. 79 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner.
