2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 341, 323, 307, 325, 354(B), 379, 504 and 506/34 of the Indian Penal Code.

3. The case of the prosecution is that the petitioner assaulted with farsa on the head of Suchen Yadav due to which he received cut injury and bleeding started.

4. Learned counsel for the petitioner has submitted that there is also a counter version of this case. It has also been submitted that both the parties have received injuries. It has been submitted by learned counsel that from his side, three persons have received injuries whereas from the side of informant, only one person has received injury. The injury report of Suchen Yadav has been annexed which goes to show that Suchen Yadav

First is lacerated wound of size 2' x 0.5 cm x skin deep over left frontal area of skull and second is swelling over right parietal region of skull of size 2' in diameter. Learned counsel for the petitioner also submits that the allegation of assault from that of farsa whereas no injury of sharp cutting have been found on the head of the injured. The petitioner is in custody since 23.03.2025.

5. Learned counsel for the informant is present. She has vehemently opposed the bail and has stated that the petitioner is having criminal antecedent and that there is no land dispute between the parties.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bangaon P.S. Case No. 145 of 2023 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM- 1st, Saharsa.
