In this case, the petitioner is seeking regular bail in connection with Akbarpur P.S. Case No. 30 of 2020, registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The petitioner has criminal history. About 72 liters of foreign liquor has been recovered from the roof of a bus, which was coming from Ranchi.

Learned counsel for the petitioner submits that the petitioner has not been arrested from the bus but, his name has come during the investigation on the confessional statement of one Rajiv Kumar and Sandeep Kumar. He further submits that co-accused namely, Suraj Kumar @ Suraj Saw and Raja Kumar

Patna High Court CR. MISC. No.36365 of 2020(2) dt.05-02-2021 2/2 @ Rajiv Kumar have been granted bail by a co-ordinate Bench of this Court vide order dated 13.05.2020 passed in Criminal Miscellaneous No. 13597 of 2020.

Looking to the period of custody as well as the fact that co-accused namely Suraj Kumar @ Suraj Saw and Raja Kumar @ Rajiv Kumar have been granted bail by this Court vide order dated 13.05.23020 passed in Criminal Miscellaneous No. 13597 of 2020, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-IIcum- Special Judge, Nawada, in connection with Akbarpur P.S. Case No.30 of 2020 subject to the condition that the petitioner shall report to the nearest Police Station by 7th of every month till six months, failing which, the prosecution will be at liberty to make prayer for cancellation of bail bonds of the petitioner.
