JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-03-2015 Heard learned counsels for the petitioners and the State. The petitioners being parents and brother of the husband of the complainant are apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Section 498A/34 of the Indian Penal Code and section 4 of the Dowry Prohibition Act. The basic accusation is of torture for non fulfillment of dowry demands.
It is submitted by learned counsel for the petitioners that
Patna High Court Cr.Misc. No.42933 of 2014 (2) dt.02-03-2015 2/2 the complainant has performed second marriage with the son of petitioner nos. 1 and 2 and at present she is residing with her first husband.
Considering the thrust of accusation against the husband of the complainant, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Munger in connection with Complaint Case No. 84C of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
