The petitioner seeks bail in Tiyar P.S. Case No. 06/2017, registered for the offences punishable under Sections 272, 273 and 34 of the Indian Penal Code and section 30, 30(A) of the Bihar Prohibition & Excise Act.
The police got information that the petitioner Sunil Kumar Singh, Ramesh Kumar Singh and Pappu Singh had kept Indian made foreign liquor to sell, on such the house of Ramesh Kumar Singh was searched. Sunil Kumar Singh the petitioner and others were also found inside the house. From the house of Ramesh Kumar Singh 204 bottles of Blue label superior grain Whiskey each containing 180 m.l., 26 bottles of Blue label superior grain Whiskey each containing 375 m.l. were recovered. It is submitted that 46 litres of Indian made foreign
Patna High Court Cr.Misc. No.19674 of 2017 (2) dt.02-05-2017 liquor was recovered and for that the petitioner is in jail since 25.01.2017. The petitioner has already remained in jail for more than 03 months.
Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate Ist Class, Ara (Bhojpur) in connection with Tiyar P.S.
