JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-04-2021 Heard the learned counsel for the petitioner and Mr. Jai Narain Thakur, learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Harsidhi P. S. Case No. 67 of 2019, dated 21.02.2019, instituted for the offences under Sections 363, 366(A) and 34 of the Indian Penal Code.

It has been alleged in the F.I.R. that the minor daughter of the informant was taken away on gun point for her to be married to the petitioner.

The learned counsel for the petitioner has

Patna High Court CR. MISC. No.36002 of 2020(2) dt.05-04-2021 2/3 drawn the attention of this Court to the statement of the victim girl recorded under Section 164 Cr.P.C., in which she has disclosed her age to be 19 years but her age has been assessed by the learned Judicial Officer to be 18 years.

In the aforesaid statement, the victim girl says that she has married the petitioner of her own volition and only because the marriage was not acceptable to her family members, the present case had been lodged. Considering the afore-stated facts, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari, in connection with Harsidhi P. S. Case No. 67 of 2019, subject to the conditions as
