The petitioners are apprehending their arrest in connection with Jandaha P.S. Case No. 137 of 2014, registered under Sections 304(B), 201 and 34 of the Indian Penal Code. The prosecution case as alleged in the First Information Report that marriage of the victim Samta Kumari was solemnised with Satendra Sahni and there is allegation after marriage there was demand of motorcycle and golden chain. On received of the information, the prosecution party came to the sasural of the victim and requested that they are poor and they are unable to fulfill the demand. It is further alleged that after sometime the informant took the victim in his house. It is further alleged that after one month prior to the occurrence the brother of the husband of the victim came and took the victim and started demand and assaulted and subjected to cruelty. Thereafter, it is learnt that victim was done to death on 15.06.2014 and dead body has been concealed and since traceless.
Patna High Court Cr.Misc. No.43964 of 2014 (3) dt.15-04-2015 Learned counsel for the petitioners submits that husband of the victim was absconded. It is further submitted that petitioners are father-in-law, mother-in-law and Dewar of the victim. Having regard to the facts and circumstances of the case, the above named petitioners in the event of their arrest/surrender within a period of four weeks in to the court below from today shall be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Jandaha P.S. Case No. 137 of 2014, subject to condition as laid down under Section 438 (2) of Cr.P.C. Further condition that husband shall appear within one month from the date of receipt of the order then bail bonds of the petitioners shall accepted.
