JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 24-05-2017 Heard learned counsel for the petitioner and the learned counsel representing the State.
The petitioner wants to renew the prayer of bail which was earlier rejected vide order dated 06.03.2017 passed in Cri. Misc. No. 1975of 2017, on the ground that the petitioner is suffering in custody since 11.11.2016 and he was given liberty to renew his prayer for bail after remaining six months in custody from the date of remand and now the petitioner has remained in custody for more than six months and, as such, the petitioner deserves sympathetic consideration.
The learned A.P.P. fairly submits that in view of the observation lenient view can be taken.
In the facts and circumstances stated above, the
Patna High Court Cr.Misc. No.19450 of 2017 (2) dt.24-05-2017 2/2 petitioner is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Sri N.K. Yadav, Judicial Magistrate, 1st Class, Jamui, in connection with Barhat P.S. Case No. 53 of 2016, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the Court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
