The petitioner is apprehending his arrest in connection with Deo Police Station Case No 5 of 2017 dated 11.01.2017 registered for offences punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is submitted on behalf of the petitioner that nothing has been recovered from his conscious possession and his name transpired on the confessional statement of apprehended coaccused. It is also submitted that co-accused Rahul Kumar has been granted bail by this Court in Cr Misc No 11084 of 2017. Heard learned APP also.

Having heard both sides and in view of provisions contained

Patna High Court Cr.Misc. No.12518 of 2017 (2) dt.27-03-2017 2/2 in Section 76 (2) of Bihar Prohibition and Excise Act 2016, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned Court below within a period of six weeks and make prayer for regular bail, which will be considered by the learned Court below on the basis of the submission, as made above, if possible, on the same day without being prejudiced by the order of this Court. With the aforesaid observation, this application is disposed of.
