====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-01-2022 Heard learned counsel for the petitioner and the State.

The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 379 of the Indian Penal Code.

As per the prosecution case, unknown criminal committed theft of motorcycle of the informant. During investigation, petitioner and other accused persons were arrested with the stolen motorcycle.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner has claimed clean antecedent and he is in custody since 8.8.2020.

Learned counsel appearing for the State opposes the

Patna High Court CR. MISC. No.35792 of 2020(4) dt.04-01-2022 2/2 prayer for bail.

Considering the rival submissions of the parties and clean antecedent of the petitioner, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Araria in Bhargama Police Station Case No. 126 of 2020.
