2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 467, 468, 420, 120B, 406/506 of the Indian Penal Code.
3. As per the prosecution case, all the FIR named accused persons including this petitioner, in connivance with each, received advance money and later on refused to execute sale deed of the land in favour of the informant.
4. Learned counsel appearing for the petitioner submits that the petitioner has not been paid a single farthing and any amount has been transferred to his account. Agreement for sale was valid for six months and during this period informant never approached the petitioner for executing the sale
Patna High Court CR. MISC. No.46252 of 2023(2) dt.10-08-2023 2/2 deed. Moreover, dispute is of civil nature. Petitioner claims clean antecedent.
5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate X, Patna in Complaint Case No. 2142C/2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
