The petitioners apprehend their arrest in a case registered for the offence under Sections 452, 341, 323, 354, 504, 34 of the Indian Penal Code.

As per the prosecution case, on 29.11.2018 at about 8 PM, while the informant was sleeping with her sister at home, petitioners entered in the house and tried to outrage the modesty of informant and her sister, but after alarm being raised by them, the grand father of informant came there and petitioners fled away from there. It is further alleged that on next day, when informant and her family members went to make complaint at petitioners' house, they were assaulted with lathi and danda.

No.49137 of 2021(2) dt.21-06-2022 2/2 It is submitted on behalf of petitioners that petitioners have been falsely implicated in this case due to land dispute between the parties. As a matter of fact, petitioners' family land is situated beside the house of informant and when they were barricading that area, it was objected by informant side, due to which, some altercation took place between them, as a result of which, the present false case has been lodged against petitioners. Petitioners claim clean antecedent. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - XII, Saran at Chapra in connection with Maker P.S. Case No. 173 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
