2. The petitioner seeks regular bail in connection with Chakki P.S. Case No. 11 of 2024 lodged on 17.09.2024 under Sections 191(2), 191(3), 190, 126(2), 115(2), 109, 352, 351(2) & 3 of the Bharatiya Nyaya Sanhita, 2023. Later on Section 103 of the BNS was also added.

3. As per the prosecution, F.I.R. has been lodged against five named accused persons, including the present petitioner, alleging that all the accused persons surrounded and assaulted the informant, who was sitting at Manegi Baba Asthan under a Banyan tree, with lathis, due to which injuries were

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He further submits that the case diary has been called for, and as per the case diary, the only allegation against the petitioner is of assault, however, due to old age, the informant's father could not sustain the injuries and subsequently died. He further submits that the petitioner has been in custody since 18.09.2024. Furthermore, the petitioner is ready to comply with all conditions that may be imposed upon him.

5. Learned APP for the State opposes the prayer for bail and submits that it is the petitioner against whom there is a specific allegation of assault with a lathi, and the injured died as a result of the said assault.

6. Upon a specific query by the Court as to whether the charge has been framed in this case, learned counsel for the petitioner submits that, to the best of his knowledge, the charge has already been framed.

7. Considering the nature of the offence, this Court is not inclined to grant bail to the petitioner at present. Accordingly, the prayer for regular bail of the petitioner is
