The petitioner, invoking writ jurisdiction of this court under Article 226 of the Constitution of India, has prayed for quashing of Confiscation Case No. 46 of 2014. In the writ petition the petitioner has not brought on record any notice issued in the confiscation proceeding. Obviously after seizure of the vehicle in question the learned Chief Judicial Magistrate was intimated, which is evident from page no. 23 of the writ petition.

The court is of the opinion that whatever objection the

Patna High Court CWJC No.18396 of 2014 (3) dt.20-08-2015 2/2 petitioner wants to raise, he would be at liberty to raise before the confiscation authority.

The writ petition stands dismissed.
