The petitioner has preferred this application for grant of regular bail in a case registered under section 364A of the Indian Penal Code.

As per the prosecution case, the husband of the informant asked the informant to arrange for Rs. 30 lacs or else his life would be in danger. The informant states that it appeared that her husband has been kidnapped.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The husband of the informant returned and his statement was recorded under section 164 Cr.P.C. (Annexure-3). In the said statement he names co-accused, Rinku Devi, Sushil Kumar, Sonu Kumar as also this petitioner. Rinku Devi has been enlarged on bail vide order dated 21.12.2021 passed in Cr. Misc.

Patna High Court CR. MISC. No.48928 of 2021(3) dt.23-03-2022 2/2 no. 26222 of 2021 while co-accused Sushil Kumar and Sonu Kumar have been enlarged on bail vide order dated 7.10.2021 passed in Cr. Misc. no. 19982 of 2021. The petitioner is in custody since 1.11.2020 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner having remained in custody for more than 1 year and grant of bail to the above named three accused persons, the petitioner is directed to be enlarged on bail in connection with Mahesi P.S. Case no. 335 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, District East Champaran.
