The petitioners seek bail in Mohania P.S. Case No. 490 of 2017, instituted for the offence under Section(s) 302, 34, 307, 326 of Indian Penal Code and Section 27 of the Arms Act. Subsequently, Section 120(B) of the Indian Penal Code was added.

Counsel for the petitioners submits that petitioners are not named in the written report. In the written report there is specific allegation against co-accused Pradeep Singh, Dimpal Singh, Neeraj Singh of causing firearm injury on account of which mother and father of the informant died.

Petitioners are in custody since 30.3.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Mohania P.S. Case No. 490 of 2017, subject to the condition that both the bailors will be close relatives of the petitioners.
