JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-03-2017 Learned counsel for the petitioner has stated that she has not stated about Section 27 of the Arms Act in Para -1 of the petition.

As such, she is permitted to make necessary correction. Heard the parties.

This application is for grant of bail in connection with Koch P.S.Case No.27 of 2016 for the offence under Sections 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act. It is submitted on behalf of the petitioner that there is no allegation of assault against the petitioner rather simply there is allegation that he caught hold the deceased and the other persons were assaulting him and as a matter of fact, he has been implicated in this case due to the fact that father of Anil Yadav was killed

Patna High Court Cr.Misc. No.14417 of 2017 (2) dt.29-03-2017 2/2 earlier and Anil Yadav is named accused in this case and he is brother-in-law of Anil Yadav so he has been implicated in this case. He is in custody for about four months. Heard learned A.P.P. also as well as learned counsel for the informant. They have opposed the prayer for bail of the petitioner. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage, however, the learned trial court is directed to expedite the trial of the petitioner. With the aforesaid observation, this application is dismissed.
