The petitioner is seeking anticipatory bail in connection with Moffassil P.S. Case No. 44 of 2019 registered under Sections 419, 420 of the Indian Penal Code and Section 10 of the Bihar Conduct of Examination Act, 1981, pending in the court of learned C.J.M., Gaya.
Learned counsel for the petitioner submits that as per allegations one Karan Kumar was found appearing in place of this petitioner in the Intermediate examination, he was arrested by police and has been granted regular bail now. In the given facts and circumstances of the case where this court finds that this petitioner had planted said Karan Kumar to appear in his place who was arrested while appearing
Patna High Court CR. MISC. No.36209 of 2019(3) dt.17-08-2019 2/2 for the petitioner, this court is not inclined to grant anticipatory bail to the petitioner.
Payer for anticipatory bail of the petitioner is rejectd. In case petitioner surrenders and prays for regular bail before the court below within a period of four weeks from today, the court below shall consider his prayer for regular bail taking into consideration that the co-accused Karan Kumar has been granted regular bail.
