JUSTICE SANJAY PRIYA ORAL ORDER 17-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Special Case No. 08 of 2016 arising out of Kishanganj Mahila P.S. Case No. 25 of 2016 instituted for the offence under Sections 376, 341, 323, 506 and 504/34 of the Indian Penal Code.
From the allegation in the written report it appears that girl is major and she has voluntarily gone to different places with petitioner and with consent of the girl, petitioner has established physical relationship with her due to which she became pregnant. Petitioner took the informant to Delhi on 28.10.2015 and, thereafter, she went with him to his house and was ousted from there. The First Information Report has been lodged on 17.6.2016.
Patna High Court Cr.Misc. No.21736 of 2017 (2) dt.17-05-2017 2/2 Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (POCSO) in connection with Special Case No. 08 of 2016 arising out of Kishanganj Mahila P.S. Case No. 25 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
