JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Kutumba P.S. Case No. 192 of 2018 registered for the offences punishable under Sections 147, 149, 353, 379 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, including Rules 4/40 of Bihar Mines and Mineral Concession Rule, 1972.

Allegation as per FIR is that when the police intercepted one tractor loaded with sand along with a plastic bag kept there, accused persons, including the petitioner came there and tried to get the tractor freed from police party and petitioner is named in the FIR.

Submission of learned counsel for the petitioner is that though he is named in the FIR along with other accused persons but no specific allegation has been attributed against

Heard learned APP also.

In view of above facts and circumstances, let petitioner surrender by 26.8.2019 and on surrender he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-VII-cumSpecial Judge, Excise, Aurangabad, in connection with Kutumba P.S. Case No. 192 of 2018, CIS No. 1108 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that petitioner has to co-operate in the investigation and appear before police as and when required, otherwise his bail bonds shall be cancelled.
