The petitioner seeks bail in Pali P.S. Case No. 10/2016, registered for the offences punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act and 18, 20 of U.A.P. Act. The allegation against the petitioner is that some extremists were stayed in the house of the petitioner. The petitioner was apprehended and it is stated that from possession of the petitioner one country made pistol with live cartridges and a mobile were recovered.
Learned counsel for the petitioner submits that the petitioner is in jail since 27.02.2016. He has already remained in jail for more than a year and the trial has not yet been concluded. Of course, the petitioner has got criminal antecedent, as four cases
Patna High Court Cr.Misc. No.5862 of 2017 (3) dt.03-03-2017 2/2 are pending against him.
Considering the facts aforesaid and the fact that the petitioner has already remained in jail for more than one year, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge V, Jehanabad in connection with Pali P.S. Case No. 10/2016, subject to the condition that one of the bailors must be father or mother of the petitioner. (Prabhat Kumar Jha, J.) Rakhi U T
