2. The learned counsel for the appellant, at the outset, seeks permission to withdraw the appeal with liberty to file a fresh Criminal Miscellaneous Application as cognizance was taken subsequent to filing of the instant appeal under the POCSO Act also.

3. Permission is accorded.

4. Accordingly, instant appeal is dismissed as withdrawn.
