====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------- 10-03-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Kotwali P.S. Case No.272 of 2016 registered under Sections 420, 465, 468 and 471 of the Indian Penal Code.

The accusation is that for transportation of Mid-day meal at the schools, tender was invited in which the petitioner and two others, namely, Sri Ram Sharma and Smt. Anjana Kumari, were selected. During verification, insurance papers of two vehicles, out of eight vehicles, the details were furnished by this petitioner, were found forged.

Learned counsel appearing on behalf of the petitioner

Patna High Court Cr.Misc. No.9702 of 2017 (2) dt.10-03-2017 2/2 submits that the petitioner is not the owner of the vehicles rather after taking the papers of vehicles from the owners, the petitioner had submitted the same before the authorities. Further submission is that the similarly situated co-accused Shri Ram Sharma has already been granted anticipatory bail by a Bench of this Court vide order dated 28.02.2017 passed in Criminal Misc. No.7129 of 2017.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna, in connection with Kotwali P.S. Case No.272 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C.
